At the court hearing today it was announced that Justice Brands was sick and the hearing was adjourned until Wednesday. One of the Judge's law clerks said she would take any items to him in the meantime.
A couple newsworthy items came up:
- Allegations that some county election boards were already opening military and federal oversea ballots that were not supposed to be opened yet.
- A significant disagreement over the rules regarding absentee ballots that have been challenged. Challengers want to have the courts review these challenged ballots, but there are counties that want to "burst the ballots" before this can happen. Once a ballot is out of the envelope there is no way to distinguish it from the rest of the paper ballots. This creates an "irreparable harm situation" against the party making the challenge.
Many board commissioners as well as county attorneys from all over the district were present. Some county's commissioners did not attend. If the commissioners are in court the ballot counting is on hold for that time. As they are respondents in the case one of the attorneys requested that they be advised they have the the right to be present at the hearings.
